TERMS & CONDITIONS

These Terms and Conditions apply to the Chooza gift card and to the Chooza digital code (either or both referred to as ‘Chooza Code’) and its use by You. By using the Chooza Code You are deemed to accept these Terms and Conditions, which shall form a legally binding contract between You and Us. You should read them carefully (you may wish to print them out).

1. Definitions

In these Terms and Conditions, unless the context otherwise requires the following words and expressions shall have the following meanings: -

1.1 Chooza Code means the physical Chooza gift card or the Chooza digital code which you have received which can be exchanged for Retailer e-Codes on the Website.
1.2 ‘Customer Care’ means the customer care centre operated by Us and for Us or on Our behalf for dealing with enquiries; as detailed in the message You received with Your Chooza Code. You can also use the Contact Us link on the Website;
1.3 ‘Our’/ ‘Us’/‘We’ means MBL Solutions Limited, registered in England and Wales with company registration number 04300822 and whose registered office is at Valley Road, Birkenhead, Merseyside CH41 7ED;
1.4 ‘Purchaser’ means the organisation that has purchased the Chooza Code(s) for Your use;
1.5 ‘Retailer e-Code(s)’ means the third party retailer e-code(s) which can be purchased from Us by exchanging the Chooza Code on the Website. (Note that the available third party retailers may change from time to time); and
1.6 ‘You’/ ‘Your’ means the person to whom the Chooza Code has been given, by or on behalf of the Purchaser (or such other permitted user of the Chooza Code). Note that the available third party retailers may change from time to time); and
1.7 ‘Website’ means
2. Use of the Chooza Code
2.2 The Chooza Code is issued to You on behalf of the Purchaser (or to the Purchaser that has given it to You).
2.3 The Chooza Code:
2.3.1 cannot be exchanged for cash and no exchange or refund will be given by Us; and
2.3.2 can only be used to purchase (that is exchanged for) Retailer e-Code(s) on the Website;
2.3.3 Instructions on how to use Your Chooza Code can be found in the message You received with Your Chooza Code (please keep that safe).
2.4 We may and will assume, unless and until We are notified to the contrary, that the person who uses the Chooza Code at any time is the rightful user of the Chooza Code.
2.5 You will not earn any interest on any funds loaded onto the Chooza Code nor receive any other benefit related to the length of time You hold the Chooza Code.
2.6 You will see the current value of Your Chooza Code when You enter the Chooza Code on to the Website (that is where you can exchange your Chooza Code
2.7 Following the expiry date of Your Chooza Code (see clause 4) the value will be lost.
2.8 You must be over the age of 18 and resident in the United Kingdom or the Channel Islands.
2.9 We will debit the amount of each purchase from the value on Your Chooza Code immediately the purchase is completed (that means immediately You exchange Your Chooza Code for one or more Retailer e-Code(s)).
2.10 If We need to investigate a transaction on the Chooza Code then You must co-operate with Us, the police or any other authorised body if this is reasonably required.
2.11 The maximum amount You can spend is the amount of the Chooza Code value. If You attempt to spend more than the balance the transaction will be declined.
2.12 The Chooza Code must not be sold by You, or by any other holder of the Chooza Code from time to time. If You give the Chooza Code to another person You will be responsible for all use of the Chooza Code and You must ensure that such person understands and complies with the obligations contained in these Terms and Conditions, particularly those relating to the use and security of the Chooza Code.
2.13 You can redeem the full value of Your Chooza Code in one transaction or in more than one transaction.
3. Lost, Stolen, Damaged, Destroyed and Unauthorised Use

We are not responsible to You if a Chooza Code is lost, stolen, damaged, destroyed or used without Your consent/permission and so You should treat Your Chooza Code like it is cash.

4. Expiry of the Chooza Code

You will see the expiry date of Your Chooza Code when You enter the code into the Website platform (that is where you can exchange your Chooza Code for a Retailer e-Code). After that expiry date, the Chooza Code will no longer be valid and You nor any other person will be able to use the Chooza Code. It will have no value.

5. Redemption

You do not have a right to redeem the value of a Chooza Code for cash, nor request a refund or otherwise exchange the Chooza Code for cash.

7. Data Protection
7.1 We are committed to maintaining all data which We collect and process in accordance with the requirements of all applicable data protection legislation, including the UK General Data Protection Regulation and the Data Protection Act 2018. We will take reasonable steps to ensure that all personal data concerning You or Your Chooza Code is kept secure against unauthorised access, loss, disclosure or destruction. Further details are contained within Our Privacy Policy and Cookie Policy, links to which can be found at the footer of the Website. By using Your Chooza Code and/or otherwise providing Us with Your personal data You agree to the terms contained within Our Privacy Policy and Cookie Policy.
6. Complaints
6.1 If You have a complaint concerning Your Chooza Code then please contact Customer Care.
6.2 All complaints will be dealt with as quickly and as fairly as possible in accordance with Our complaints procedure, details of which can be obtained by contacting Customer Care.
8. Changes or Cancellations

Once you have exchanged your Chooza Code for a Retailer e-Code no changes or cancellations are possible.

9. Third Party Retailers

Once you have exchanged your Chooza Code for a Retailer e-Code you are subject to that third party retailer’s terms and conditions.
If a third party retailer becomes insolvent you may not be able to use that third party retailer’s Retailer e-Code and your Retailer e-Code may have a reduced value or no value.

10. Rights of Third Parties

These Terms and Conditions do not create any right enforceable by any person who is not a party to them, except that: -

10.1 these Terms and Conditions may be enforced by Us;
10.2 a person who is the permitted successor or assignee of the rights of a party referred to in these Terms and Conditions is deemed to be a party to these Terms and Conditions and the rights and obligations of such successor or assignee shall, subject to and upon any succession or assignment permitted by these Terms and Conditions, be regulated by these Terms and Conditions.
11. Variation
11.1 We may vary these Terms and Conditions as and when We require, provided that We have given You reasonable notice of any such variation, unless a change in the law does not allow Us to provide You with prior notice.
11.2 Notification of any variation to these Terms and Conditions will be provided to You either by email, or post, or on the Website at our sole choice and/or by any other agreed means and You agree that this is an appropriate method to vary these Terms and Conditions.
12. Governing Law and Jurisdiction

These Terms and Conditions shall be governed in accordance with English Law and the parties hereby submit to the exclusive jurisdiction of the courts of England and Wales. All communications with You will be in English.
